RECENT CASES
NOT GUILTY - February 2024 |Man in Park County charged with multiple attempted first degree murder allegations. He was successfully defended by Chris Ponce, Esq. and co-counsel. After a two week, intense trial against prosecutors for the 11th judicial district attorney's office, the jury deliberated for approximately 2 hours and 45 minutes, returning not guilty verdicts on all 19 charges submitted by the District Attorney. This included 6 counts of attempted first degree murder by extreme indifference, 3 counts of attempted second degree murder, 6 counts of first degree assault on a police officer, child abuse, and reckless endangerment. The jury did a commendable job in seeing through the one-sided story by the district attorney and rightly finding that our client did nothing wrong and was innocent.
DISMISSAL - November 2023 | Man in Jefferson County charged with two counts of strangulation and domestic violence. Mr. Ponce successfully defended this honorably discharged veteran against false claims made by his girlfriend. The woman had lied to police. When police arrived they saw that the client had injuries, his vehicle was damaged, and there was a video of the accuser threatening him with a gun. The woman told police that she had been on the waiting list for a heart transplant for 8 years, and was able to deceive the officers into believing her. Mr. Ponce subpoenaed the research team at the United Network of Organ sharing and obtained an affidavit showing that this accusing woman had never been on the list for any heart transplant ever. This case was dismissed.
DEFERRED SENTENCE - August 2023 | Douglas County. Working professional charged with violent crimes, including assault on a police officer, second degree assault with a deadly weapon, and child abuse. Mr. Ponce successfully litigated the case for a year, provided extensive mitigation and legal briefing, and demonstrated that the client was suffering from a mental health crisis at the time of the incident. Mr. Ponce advocated at the Department of Human Services proceeding, and this client will have no criminal history or negative criminal justice consequences and will be able to move on with his/her life.
DISMISSAL - January 2023 | Working professional charged with Driving Under the Influence. Mr. Ponce successfully researched his case and learned that potent chemicals that were near the officer at the time he stopped the client contributed to the officer believing that he smelled alcohol coming from the client's vehicle. Mr. Ponce was able to demonstrate that the presence of the chemicals misled the officer into thinking that alcohol was in the client's vehicle, when it in fact was not. The DUI against this client was dismissed.
